Cuyahoga Company Enjoins Land Owners From Cutting Trunk Line Poles
Wires Involved Link City With the State and Country
Injunction tables were turned in common pleas court yesterday. Indstead of an individual restraining a corporation a corporation got an order against individuals.
The case was that of the Cuyahoga Telephone Co. against William Schaleno, Augusta Modenbach; Anna Oxford and Elizabeth Sprague, children of the late Jacob Schaleno.
Since the death of Anna Ott, the original owner of the property in Newburg township, the defendants and the company have not been able to reach an agreement as to a line of telephone poles. Anna Ott had a life interest only in the premises, and those now in possession of the property the corporation says, threaten to cut down and destroy the wires and poles.
It is stated that this telephone line is the principal means of communication of the plaintiff in the city of Cleveland, and all other points in the state and other states, and the only means of communication between the company’s patrons inside the city, and most of the outside connecting lines and exchanges.
Anna Ott died recently. The petition says that negotiations have been begun to extend the plaintiff’s rights, but so far there has been only discord, the property owners declaring they do not want the poles and other paraphanallia upon their premises. This property is located not far from Stop 7 on the A. B. & C. line. The restraining order was granted by Judge Schwan. [16]
