For Horse Stealing
In criminal court yesterday morning William Rubensaal, a little boy only 14 years of age, was put on trial before Judge Stone and a jury on a charge of horse stealing. It seems that the boy on Dec. 7, last, it being Sunday, drove a gelding belonging to his employer, William Southwick, from Gates’ Mills to South Euclid. He was overtaken and arrested and the animal, a gelding worth $125, recovered. The defense was that the boy merely drove the horse over there in order to spend 5 cents in the general store in South Euclid.
Cleveland Plain Dealer, January 17, 1891
Prosecuting Attorney Neff won his first two cases and lost the third. At 2:15 p.m. yesterday the jury in the case of the state of Ohio against William Rubensaal returned a verdict of not guilty.
Rubensaal is a little lad of 14 years and is, perhaps, disposed to be reckless. Dec. 7 he was at work for a farmer in the country, by name William Southwick. It was Sunday. Rubensaal drove off with a valuable gelding belonging to Southwick and was followed and arrested and ultimately bound over for horse stealing. At his trial his defence was that he had no intention of stealing the beast but only meant to drive to South Euclid and buy a cigar. The jury preferred to believe him. His youth was in his favor and the state did not have a strong case. It will no doubt be a lesson of prudence to the boy. A charge of wrongfully using the horse still stands against him.
